Terms of Service

1. Acceptance and who operates the service

These Terms of Service (also called Terms of Use) govern the use of Nossas Finanças (nossasfinancas.com.br), a web app for personal, multicurrency financial organization with end-to-end encryption (E2EE), operated by Marcelo Salgado Caliman (an individual). By creating an account or using the service, you declare that you have read, understood and agree to these Terms and to the Privacy Policy, which is an integral part of them. If you do not agree, do not use the service.

2. What the service is

Nossas Finanças is a tool for financial organization and calculation. It brings together net worth, budget, goals, projections and indicators (such as the “financial freedom” metric) from the data you enter. We offer a free core and an optional paid Pro plan with advanced features (see section 8). Exchange and asset quotes, when shown, are informational, may be delayed and depend on third-party sources.

3. Eligibility

You must be 18 or older and have full legal capacity to use the service — or 16 or older with the consent and supervision of your legal guardians. By using the app, you declare that you meet these requirements and provide truthful registration information.

4. Not financial advice

The numbers, projections, scenarios and indicators in the app are informational and educational and depend entirely on the data and assumptions you provide. They do not constitute financial, investment, tax, accounting or legal advice, nor a recommendation to buy or sell any asset. Decisions are exclusively yours; for your specific case, consult a qualified professional.

5. Your account, password and recovery code

• You are responsible for keeping your password and your recovery code safe and for the activity on your account. Because the app is E2EE, the key that opens your data is derived from your password and is never sent to the server.

• For that reason, losing your password AND recovery code means losing access to the data permanently — there is no recovery, not even by us. That is the price of real privacy.

• You are responsible for the accuracy of the data you enter and for using the service lawfully. We recommend exporting backups regularly (Settings → Data). You own your data.

6. Acceptable use

You agree not to: (a) use the service for illegal or fraudulent purposes; (b) violate third-party rights or applicable laws; (c) attempt to bypass security, encryption or usage limits; (d) overload or abuse the infrastructure (e.g., abusive automation, scraping, unauthorized reverse engineering); (e) resell or redistribute the service without authorization. We may suspend or terminate accounts that breach this section.

7. Intellectual property

The software, the “Nossas Finanças” brand, the design, texts and other elements of the service are owned by the operator and protected by law. We grant you a personal, limited, non-exclusive, non-transferable and revocable license to use the app under these Terms. You do not acquire rights over the software and may not copy, modify or commercially exploit it without authorization.

The financial data you enter remains yours — we claim no ownership over it and, because it is encrypted on your device, we cannot even read it.

8. Pro plan and subscription

• The core of the app is free. The Pro plan (optional) unlocks advanced features, with a monthly (R$ 9.90) or annual (R$ 100) subscription, processed by Stripe. Your card details go straight to Stripe; we never see or store them.

• Free trial: once per account, you may start a 14-day Pro trial. At the end of the trial, billing is automatic unless canceled beforehand.

• Renewal and cancellation: the subscription renews automatically at the end of each cycle. You may cancel at any time in Settings → Plan; Pro access continues until the end of the period already paid, and there are no future charges after cancellation.

• Refunds: periods already paid are not refunded — cancellation only stops the following charges. This does not remove the withdrawal and refund rights provided by law (e.g., the Brazilian Consumer Code) where applicable.

• Payment failure: if the card is declined, Stripe retries; if it persists, the subscription is suspended and Pro is disabled until it is resolved — without losing your data.

• Prices may change; changes apply to future cycles, with reasonable prior notice.

9. Third-party services

The service relies on providers operating under contract: Supabase (authentication and encrypted-vault storage), Vercel (hosting), Stripe (payments), Resend (emails), Cloudflare Turnstile (anti-spam) and exchange & market-reference APIs (e.g., Frankfurter, Coinbase). Use of these features is also subject to the respective providers' terms. We are not responsible for unavailability, errors or changes of third-party services beyond our control.

10. Availability, changes and “as is”

The service is provided “as is” and “as available”, without any guarantee of uninterrupted, error-free operation or fitness for a particular purpose. We may change, suspend or discontinue features (seeking to give reasonable notice when the change is relevant). Third-party-dependent features may vary or become unavailable.

11. Disclaimer of warranties and limitation of liability

To the maximum extent permitted by applicable law, the service is provided without warranties of any kind. We are not liable for: losses or damages arising from use or the inability to use; financial decisions made based on the app; unavailability or interruptions; inaccuracy of data you entered or of third-party quotes; or loss of access due to misplacing your password and/or recovery code.

Where total limitation is not permitted, the operator's aggregate liability is limited to the amount you actually paid for the service in the 12 months prior to the event — and to nothing if you use only the free plan. Nothing in these Terms removes non-waivable consumer rights provided by law (e.g., the Brazilian Consumer Code / LGPD).

12. Indemnification

You agree to indemnify and hold harmless the operator from claims, losses and expenses (including reasonable fees) arising from your misuse of the service, your breach of these Terms or your violation of third-party rights or the law.

13. Community

Taking part in the community (e.g., an Instagram profile) is optional and subject to the space's rules and the host platform's terms. Content posted by other participants is the responsibility of whoever posts it; we neither endorse nor are responsible for third-party opinions in the community, and nothing there constitutes financial advice.

14. Termination and suspension

You may delete your account at any time (Settings → Account), which permanently erases the encrypted vault. We may suspend or terminate accounts that breach these Terms or the law, or in the face of a risk to the security of the service. Once the account ends, the licenses granted cease; clauses that by their nature survive (e.g., intellectual property, limitation of liability, indemnification, governing law) remain in force.

15. Privacy

The processing of your data is governed by our Privacy Policy, which is an integral part of these Terms and details end-to-end encryption, the legal bases (LGPD/GDPR) and your rights.

16. Changes to these Terms

We may update these Terms from time to time; the “last updated” date above indicates the current version. Relevant changes will be communicated by reasonable means. Continued use after a new version takes effect means agreement with it; if you do not agree, stop using the service and, if you wish, delete your account.

17. Governing law and venue

These Terms are governed by the laws of the Federative Republic of Brazil. For consumer relations, the user is assured the venue of their own domicile, under the Brazilian Consumer Code; in other cases, the operator's domicile venue applies. We will seek to resolve any disputes amicably via contato@nossasfinancas.com.br before any judicial measure.

18. General provisions

If any clause of these Terms is deemed invalid, the remaining ones stay in force. Any tolerance regarding a breach does not mean a waiver of rights. You may not assign these Terms without our consent; we may assign them in case of reorganization or transfer of the service, preserving your rights. These Terms, together with the Privacy Policy, constitute the entire agreement between you and the operator regarding the service.
